Институциональные механизмы урегулирования споров между бизнесом и органами власти: краткий обзор

В настоящее время многие страны признают актуальным создание институциональных механизмов урегулирования споров между бизнесом и органами власти и иными лицами публичного права. Такие механизмы на сегодняшний день существуют, но находятся, в целом, в стадии становления.

Представляется, что приведенный в этой краткой обзорной статье международный опыт, при условии соответствующей адаптации и формирования надлежащей нормативной основы, следует учесть при выработке механизмов урегулирования споров между бизнесом и органами власти.

Dmitry Davydenko. Institutional mechanisms for resolving disputes between business and public authorities (a working paper in Russian)

Currently, many countries recognize the creation of institutional mechanisms for the settlement of disputes between business and government authorities and other persons of public law as relevant. Such mechanisms exist today, but are, in general, more or less in the stage of formation.

It seems that the international experience presented in this brief working paper, subject to appropriate adaptation and the formation of an appropriate regulatory framework, should be taken into account when developing mechanisms for resolving disputes between business and public authorities.

Based in Moscow, Dr Davydenko is the Director and a co-editor of the CIS Arbitration Forum. He is an associate professor at the Moscow State Institute of International Relations (MGIMO University), Department of Private International and Civil Law. Dmitry Davydenko has experience as an arbitrator in the ICC and other arbitral proceedings and is listed as a recommended arbitrator of International Commercial Arbitration Court and Maritime Arbitration Commission at Russian Chamber of Commerce and Industry, as well as of other reputed arbitral institutions. Included in the list of best practitioners in arbitration in Russia as of the years 2017, 2018 and 2019 by Who’s Who Legal and Global Arbitration Review (GAR). He also acts as a Russian law expert on various matters related to international commerce.
