Resolution of an insurance dispute over fishing at the Maritime Arbitration Commission

В статье рассмотрен пример из практики Морской арбитражной комиссии при ТПП РФ по спору из договора страхования в связи с посадкой судна на мель. Основным предметом данного спора стали требования к укомплектованию судна экипажем, которыми должна определяться мореходность этого судна при его выходе в рейс. Ключевым для разрешения данного спора стал вопрос о классификации судна в качестве рыбопромыслового.

The article examines an example from the practice of the Maritime Arbitration Commission at the Russian CCI on a dispute arisen out of the insurance contract in connection with the landing of the vessel. The main subject matter of this dispute included the requirements for the manning of the vessel by the crew, which should determine the seaworthiness of this vessel when it leaves the voyage.  The issue of classifying the vessel as a fishing vessel became the key to resolving this dispute.
